Terms of Service

By accessing or using Postai, you agree to be bound by these Terms of Service. Please read them carefully before using the service. If you do not agree with any part, you may not access the platform.

1. Identification of the controller

The owner of the Postai service is Llorenç Crespo Pratginestós, NIF 47976114T, with address for notifications in Olot, Girona, Spain.

2. Definitions

  • Service: the Postai platform, available at postai.es, including all its features.
  • User: any individual or legal entity that accesses or uses the platform.
  • End client: the company or LinkedIn profile managed by the User.
  • Generated content: texts, post outlines and material produced with AI.
  • Subscription: paid access to features according to the contracted plan.

3. Registration and user account

3.1 Requirements

  • Be over 18 years old or have legal capacity to contract.
  • Provide accurate, complete and up-to-date information at registration.
  • Keep access credentials confidential.
  • Use the service exclusively for legitimate purposes and in accordance with these terms.

3.2 Account responsibility

You are responsible for all activity carried out from your account. You must immediately notify any unauthorized access to hola@postai.es.

4. Plans and billing

4.1 Available plans

  • Solopreneur: €49/month or €470/year. Includes 1 company and 1 LinkedIn profile.
  • Business: €297/month or €2,850/year. Includes 1 company and 25 LinkedIn profiles.
  • Agency: €497/month or €4,776/year. Includes 5 companies and 20 base profiles.

4.2 Payment terms

  • Billing is processed in advance at the beginning of each period.
  • Subscriptions renew automatically unless cancelled in advance.
  • Payment is processed through Stripe. We do not store card data.
  • Prices include VAT where applicable.
  • We reserve the right to modify prices with at least 30 days' notice.

4.3 Cancellation and refunds

You can cancel your subscription at any time from your dashboard or the Stripe portal. You will keep access until the end of the paid period. No refunds are issued for partial periods.

5. Acceptable use of the service

5.1 Commitments

  • Comply with all applicable laws and regulations.
  • Respect third-party rights, including intellectual property and privacy.
  • Review and approve all AI-generated content before publishing.
  • Keep credentials confidential.

5.2 Prohibited uses

  • Illegal or fraudulent activity.
  • Attempting to compromise the security of the platform or other accounts.
  • Bots or automated scripts without authorization.
  • Reselling, sublicensing or redistributing access to third parties.
  • Generating content that infringes rights, is defamatory, discriminatory or contrary to regulations.
  • Generating spam or practices contrary to LinkedIn policies.

6. Artificial intelligence and generated content

Postai uses the Anthropic API (Claude) to generate plannings and texts. The content is indicative and does not replace the User's editorial judgment, who is solely responsible for reviewing and approving it.

Generated content may be freely used by the User, who guarantees that its use does not infringe third-party rights. Postai may use anonymized usage data for improvement purposes.

7. Intellectual property

Postai owns all rights to the platform (code, design, brand, algorithms). The User retains rights over the documents they upload; by uploading them they grant a limited license to process them only for the purpose of providing the service.

8. Privacy and data protection

Data processing is governed by the Privacy Policy, which forms an integral part of these Terms. Postai complies with GDPR and Spanish LOPDGDD.

9. Security and availability

We apply appropriate technical and organizational measures. We do not guarantee 100% uninterrupted availability. In case of an incident we will notify within legal timeframes.

10. Limitation of liability

Postai provides the service "as is". Total liability shall not exceed the amount paid by the User in the last 12 months.

11. Suspension and termination

Postai may suspend or terminate the service in case of serious breach, fraudulent use, repeated non-payment or conduct that compromises security. In non-serious cases, 7 days' notice will be given to resolve.

12. Modifications

Postai may modify the service or these Terms with reasonable notice. Substantial changes are notified by email.

13. Governing law and jurisdiction

These Terms are governed by Spanish law. For disputes between businesses, the courts of Girona; for consumers, those of their domicile.
